Most guidance on Kenyan trusts stops at registration. But a registered trust is a living structure: trustees hold property, money moves, beneficiaries grow up and trustees themselves change. What keeps a trust healthy year to year is unglamorous administration, and it is the absence of that administration , not the original drafting , that produces most of the trouble seen later.

What records must trustees keep?
Trustees are stewards of property that belongs, in substance, to the beneficiaries. The trust deed and the Trustee Act set out the duties; in practice the core records are the trust’s accounts, minutes of trustees’ meetings, a register of the property held and the documents of title, and records of every distribution made. Beneficiaries are entitled to information about the trust’s administration, and accounts maintained properly are what make that entitlement easy to satisfy.
What are the recurring housekeeping tasks?
- checking that title documents, bank accounts and utility records are actually in the trustees’ names;
- holding trustees’ meetings at sensible intervals and minuting the decisions taken;
- updating the register of trustees where trustees change, so the public record matches reality;
- attending to the trust’s tax registration and filing obligations where they apply;
- reviewing investments against the trustees’ duty to act prudently and within their powers.
How does a registered trust interact with the tax system?
Trusts may need to register and file for tax purposes, and the treatment of income received by trustees depends on its source and on how the deed allocates it. Trustees should establish the position early with the Kenya Revenue Authority rather than assume that a family arrangement stands outside the system. Tax questions are far easier to answer in advance than to unwind afterwards.
What happens when administration slips?
Disputes among family members, personal exposure for trustees who cannot account, and stalled sales , a buyer’s lawyers will examine the trust’s documentation before completing a purchase of trust land. Registration records are maintained by the Business Registration Service, and keeping them current is part of the trust’s hygiene.
